This coming October 2012 sees more changes to the Immigration Rules that will not only affect those that have overstayed their welcome in the UK but will now include those migrants that have overstayed by 28 days. These changes will affect:
the points-based system;
all working and student routes;
visiting routes;
all working and student routes;or
discharged HM Forces; or
The 9 July 2012, also saw new changes to settlement rights which are to be in line with the October 2012 changes to take place.
The 28 day decision on "policy discretion" comes to an end, the Home Office will not grant grace time as in the past, so migrants will be expected to have either been granted further leave before leave expires or leave the UK and re-enter with a new visa.
The Border Agency will ensure that those migrants with limited leave to remain that fail to apply for an extension to their last leave, or after the 28 day period will be automatically refused further leave.
Reported Removals of illegal immigrants:-
The West Midlands, saw over 250 illegal immigrants being removed from Warwickshire, West Mercia as one its largest project by the BIA.
Since 8 May this year officers from the agency's Solihull HQ have stepped up efforts to locate, arrest and detain foreign nationals who have overstayed their limited leave to remain visas. Up until 12 July, 102 visa overstayers and 154 other immigration offenders had been arrested and removed following unannounced visits by our officers.
Those migrants that are still in the UK with no status will be barred from re-entry should they fail to regularizes their status or seek legal advice on how to resolve their immigration status.
These figures included some that were removed by force, and others that volunteered their departure, but nevertheless whilst contacted by the BIA after having been checked by the e=boarder database, holds all the records of passengers entering the UK.
